These Settlements resolve:

  • a securities Class Action on behalf of: all Persons who purchased the common stock of Home Solutions of America, Inc. during the period between April 11, 2006 and March 5, 2007, inclusive, and were damaged thereby (the “Class”); and

  • a derivative action on behalf of all Persons who currently own Home Solutions of America Inc. common stock (the “Derivative Action”).

IF YOU ARE A MEMBER OF THE CLASS, YOUR RIGHTS WILL BE AFFECTED AND YOU MAY BE ENTITLED TO SHARE IN A $3.5 MILLION SETTLEMENT FUND. If you have not yet received the full printed Notice of Proposed Settlements of Class Action and Derivative Action, Motion for Attorneys’ Fees, and Settlement Fairness Hearing and a Proof of Claim form, you may obtain copies on this website.

Participate in the Settlement

If you are a Class Member, in order to share in the distribution of the Net Settlement Fund, you must submit a Proof of Claim and Release Form postmarked by February 26, 2009, establishing that you are entitled to recovery. You will be bound by any judgment rendered in the Action whether or not you make a claim.

Exclusions and Objections

If you desire to be excluded from the Class, you must file a request for exclusion postmarked by February 26, 2009, in the manner and form explained in the Notice. All Class Members who have not requested exclusion from the Class will be bound by any judgment entered in the Action pursuant to the Amended Stipulation and Agreement of Settlement.

Any objection to any of the matters to be considered at the Settlement Fairness Hearing must be mailed or delivered such that it is received by the Court, Plaintiffs' Lead Counsel and Counsel For Defendants no later than February 26, 2009.

Settlement Fairness Hearing

The Court will hold a Settlement Fairness Hearing at 3:00 p.m. on Monday, March 23, 2009, at the United States District Court for the Northern District of Texas, 1100 Commerce St., Room 1358, Dallas, Texas 75242. At the Hearing the Court will consider whether the Settlement is fair, reasonable, and adequate. If there are objections, the Court will consider them. The Court will listen to people who have asked to speak at the hearing. The Court may also decide how much to pay to Plaintiffs’ Lead Counsel. After the Settlement Fairness Hearing, the Court will decide whether to approve the Settlement. We do not know how long these decisions will take.
